1. Introduction

These Terms and Conditions ("Terms") govern your use of the Dietsync website (the "Site") and the Dietsync mobile application (the "App"), collectively referred to as the "Service". The Service is owned and operated by Frixos Dimitriadis ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Medical Disclaimer (CRITICAL)

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. The contents of the Dietsync Service, such as text, graphics, images, and other material are for informational and educational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

  • Never disregard professional medical advice or delay in seeking it because of something you have read on the Service.

  • If you think you may have a medical emergency, call your doctor or emergency services immediately.

  • Reliance on any information provided by Dietsync is solely at your own risk.

3. User Accounts

To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

  • Account Security: You are responsible for safeguarding the password that you use to access the Service.

  • Account Deletion: You may delete your account at any time directly within the App settings or by contacting support. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy.

4. Subscriptions and Payments

Dietsync offers a coaching service ("Premium Plan") which is purchased and managed externally through our website.

  • External Payments: Payments are processed via Stripe/PayPal on the Dietsync website, not through Apple’s In-App Purchase system.

  • Refund Policy: As the services provided are digital coaching and content, all sales are final and non-refundable, except where required by law.

  • Cancellations: You may cancel your subscription at any time via the website. Cancellation will take effect at the end of the current billing cycle.

5. Community Guidelines (User Generated Content)

The Service includes a "Community" feature that allows users to interact. To ensure a safe environment, you agree to the following zero-tolerance policy:

  • Prohibited Content: You may not post content that is objectionable, offensive, unlawful, deceptive, or harmful (including hate speech, harassment, bullying, or pornography).

  • Enforcement: Dietsync reserves the right to remove any content and permanently ban any user who violates these guidelines without prior notice.

  • Reporting: Users can report objectionable content or abusive behavior by contacting support at info@diet-sync.com. We will review and act on such reports within 24 hours.

6. Apple Device Terms

If you are accessing the Service via an application on an Apple iOS device, the following terms apply:

  • Acknowledgment: These Terms are between you and Dietsync only, not with Apple. Apple is not responsible for the Service or the content thereof.

  • Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control.

  • Maintenance: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

  • Warranty: Apple is not responsible for any product warranties, whether express or implied by law.

  • Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Third Party Beneficiary: Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you.

7. Limitation of Liability

In no event shall Dietsync, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
